Terms and Conditions for RTI Support Services by Bima Samadhan

These Terms and Conditions ("Terms") govern the provision of RTI Support Services ("Services") by Bima Samadhan ("Company") to clients ("Client") seeking assistance in drafting and submitting Right to Information (RTI) applications to various government authorities. By availing of these Services, the Client agrees to abide by these Terms in their entirety.

1. Scope of Services

1.1. The scope of Services provided by the Company is limited to the drafting and filing of RTI requests only.
1.2. Clients may seek assistance for filing first and second appeals regarding RTI requests, which are subject to additional fees as specified in the service agreement.
1.3. The Company does not undertake any responsibility for the subsequent actions taken by the government authority in response to the application.
1.4. The Company does not provide legal advice or representation services under these Terms.

2. RTI Support Plans

The Company offers two distinct support plans for RTI Services:

2.1. Basic Support

  • Description: Basic Support includes the drafting of an RTI application based on the information provided by the Client and the submission of the RTI request to the relevant authority, as per the Client's discretion.
  • Services Included:
    • Drafting the RTI application.
    • Submission of the RTI request to the relevant authority.

2.2. Premium Support

  • Description: Premium Support provides complete assistance through telephone by an RTI expert. It includes help in drafting the RTI application by understanding the Client's requirements, complete online tracking of the request, and assistance in finding the appropriate Public Authority to file the RTI.
  • Services Included:
    • Personalized telephone support from an RTI expert.
    • Comprehensive help in drafting the RTI application tailored to the Client's needs.
    • Complete online tracking of the RTI request status.
    • Guidance in identifying the appropriate Public Authority to file the RTI application.

3. No Guarantee of Response

3.1. The Company shall make all reasonable efforts to ensure that the RTI application is filed in compliance with the applicable laws and regulations.
3.2. However, the filing of an RTI request does not guarantee a response or the desired outcome from the concerned government authority. The Company cannot be held liable for any lack of response or an unsatisfactory reply from the authority.
3.3. The Company is not responsible for any delay, rejection, or non-disclosure of information by the government authority. The outcome of the RTI request is solely at the discretion of the authority.

4. Service Limitations

4.1. The Company’s responsibility is limited to drafting the RTI application in accordance with the information and documents provided by the Client and submitting it to the designated authority.
4.2. The Company shall not be responsible for pursuing or following up on the RTI application after submission. Any further action or appeal shall be the responsibility of the Client.
4.3. Some RTI requests may require submission of valid identification and address proof of the information seeker. In such cases, the Client is responsible for providing the necessary documentation.
4.4. The Company does not guarantee that the information requested will be provided, as government authorities may invoke exemptions under the RTI Act to deny access to certain information.

5. Charges and Payments

5.1. The fees for the Services are as specified in the service agreement and are payable in advance.
5.2. The service fee includes one-time charges for drafting and filing the RTI application, with no additional charges borne by the Client for this process.
5.3. However, after filing the RTI, if the public authority requires an additional fee to release the requested information, the Client shall be responsible for paying this additional fee directly to the authority.
5.4. Any additional costs incurred in filing the RTI application, including postal charges or additional application fees required by the authority, shall also be borne by the Client.
5.5. Payments once made are non-refundable, except in cases where the Company fails to file the RTI application due to its own fault.

6. Client Responsibilities

6.1. The Client is required to provide accurate and complete information necessary for the preparation of the RTI application. The Company shall not be liable for any errors or omissions resulting from inaccurate or incomplete information provided by the Client.
6.2. The Client must ensure that the purpose for which the information is being sought through the RTI request complies with applicable laws and regulations.
6.3. The Client agrees to promptly notify the Company of any change in contact information or any other relevant details that may affect the handling of the RTI application.

7. Limitation of Liability

7.1. The Company shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the Services, including loss of information or any failure to obtain the desired information.
7.2. The Company’s liability is limited to the fees paid for the specific Services rendered. In no event shall the Company’s liability exceed the amount paid by the Client for the Services.

8. Confidentiality

8.1. The Company shall maintain the confidentiality of any information provided by the Client in connection with the Services.
8.2. The Company shall not disclose any information to third parties without the Client’s consent, except as required by law or as necessary to complete the Services.

9. Privacy Policy

9.1. Bima Samadhan collects information provided voluntarily by the Client, including but not limited to personal details, contact information, and supporting documents required for the preparation and filing of RTI applications. This information is collected solely to facilitate the Services and ensure compliance with applicable laws.

9.2. Any files or documentation submitted by the Client for the purposes of the RTI application are provided voluntarily. By submitting these files, the Client consents to their use in the RTI process as outlined in these Terms.

10. Governing Law and Dispute Resolution

10.1. These Terms shall be governed by the laws of India.
10.2. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Ludhiana (Punjab), India.

11. Amendments and Modifications

11.1. The Company reserves the right to amend or modify these Terms at any time without prior notice.
11.2. The Client is advised to review these Terms periodically for any updates.

12. Acceptance of Terms

12.1. By availing of the Services, the Client acknowledges that they have read, understood, and agreed to these Terms in their entirety.
